Terms and Conditions for 1-on-1 Video Creator Mentorship

These Terms and Conditions govern the 1-on-1 Video Creator Mentorship program offered by Pondering Painter. By purchasing and participating in the Program, you agree to be bound by these Terms. Please read them carefully.

1. Program Description

The Program consists of:

• One private 90–120 minute 1:1 mentoring call via Zoom or Instagram (at a mutually agreed time).
• Guidance on script writing, idea generation, performance coaching, on-camera presence, and editing techniques.
• Collaborative co-creation of one short-form reel/video from concept to final export.
• Posting of the co-created reel on the Mentor’s main social media page (subject to the Mentor’s editorial discretion and platform rules).

The Program is designed for educational and collaborative purposes to help Participants improve their skills in creating surreal, silly, and absurd comedy content. It is not a guarantee of any specific outcome, follower growth, views, engagement, or financial results.

2. Eligibility

You must be at least 16 years old or if you are younger have a parents or guardians permission to participate. By purchasing, you confirm you meet this requirement and have the legal capacity to enter into this agreement.

3. Pricing and Payment

• Current price: £100 (limited-time offer; standard price £200).
• Payment is due in full at the time of booking via the designated payment method.
• All payments are non-refundable except as explicitly stated in Section 6 below.
• Prices are in British Pounds (£) and inclusive of VAT unless otherwise stated.

4. Scheduling and Participation

• After payment, the Mentor will contact you to schedule the call within a reasonable timeframe (usually within 14 days, subject to availability).
• You are responsible for providing any necessary materials, ideas, or assets before the call if requested.
• The Mentor will make reasonable efforts to accommodate your schedule, but sessions are subject to the Mentor’s availability.
• If you miss the scheduled call without 48 hours’ notice, the Mentor may reschedule at their discretion, but is not obligated to do so. A second missed call without notice may result in forfeiture of the session.

5. Co-Creation and Video Posting

• The co-created reel will be a joint creative effort. Both parties will contribute ideas, but the final creative decisions (including whether the video is suitable for posting) rest with the Mentor.
• The Mentor reserves the right to decline posting any video that does not meet their content standards, brand, or quality expectations.
• Once posted, the video remains under the Mentor’s page and control. The Mentor may edit, remove, or repurpose the video at any time.
• You grant the Mentor a perpetual, royalty-free, worldwide license to use, display, promote, and distribute the co-created video (and any clips or derivatives) on their platforms.

6. Refunds and Cancellations

• No refunds will be issued after the mentoring call has taken place or after co-creation has begun.
• Full refund (minus transaction fees) is available only if you cancel before any call is scheduled and before any work on the reel has started.
• If the Mentor cancels the Program for any reason (except Participant breach), you will receive a full refund.
• Chargebacks or disputes without valid grounds may result in legal action for recovery of costs.

7. Intellectual Property

• All pre-existing materials, techniques, templates, and strategies provided by the Mentor remain the Mentor’s intellectual property. You are granted a limited, non-exclusive, non-transferable license to use them for your personal content creation only.
• You retain ownership of your original ideas and contributions, but grant the Mentor the license described in Section 5.
• You agree not to share, resell, or distribute the Mentor’s proprietary methods, scripts, or editing techniques without explicit written permission.

8. Confidentiality

Any private information shared during the call (e.g., business strategies or personal details) will be kept confidential by the Mentor, except where required by law. You agree to keep the Mentor’s specific techniques and business processes confidential.

9. Disclaimer and Limitation of Liability

• The Program is provided “as is”. The Mentor makes no guarantees regarding results, virality, or success.
• To the fullest extent permitted by law, the Mentor shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your participation.
• Total liability shall not exceed the amount paid by you for the Program.
• You are responsible for your own content and any legal issues arising from the video you help create (e.g., copyright infringement, defamation).

10. Conduct and Termination

The Mentor reserves the right to terminate the Program without refund if you engage in abusive, disrespectful, or unlawful behaviour toward the Mentor.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

The Mentor may update these Terms from time to time. Continued participation after changes constitutes acceptance of the new Terms.
